Terms and Conditions

By participating in this promotion, you are deemed to accept the below Terms and Conditions and to have agreed to be bound by them.

1. Promoter: The promoter of this promotion is Gallagher Australia Pty Limited (ABN 37005550845) (“Gallagher”, “we”, “our”, “us”).
2. Eligible Entries:
   1. a. To be eligible to participate in this promotion, you must be resident in New South Wales, Victoria or South Australia and aged 18 years or over and have complied with the steps for entry below. 
   2. Directors, officers or employees (and their immediate families) of Gallagher are ineligible to enter. Immediate family means spouses (including de-facto), parents, children, grandparents, and grandchildren.
3. Promotion and Qualifying Purchase Periods:
   1. The promotion commences on 19 January 2026 and will close at 11.59pm (local time in Victoria) on 30 April 2026 (“Promotion Period”).
   2. For the purposes of this promotion, the period during which purchases can qualify for entries is the period from 1 January 2026 up to and including 30 April 2026 (“Qualifying Purchase Period”).
   3. We will not accept any entries after the end of the Promotion Period.
4. How to Enter:
   1. To enter, you must, during the Qualifying Purchase Period, complete the purchase of at least 300 eShepherd neckbands. 
   2. You will receive one entry into the draw for a purchase of at least 300 neckbands. You will receive a second entry if you purchase 600 or more neckbands. A maximum of two entries is permitted per customer.
   3. Any cost associated with purchasing the eShepherd neckbands is the entrant’s responsibility. No additional entry fee or surcharge applies.
   4. For entrants in Victoria, supply of eShepherd neckbands may be subject to manufacturer or regulatory approvals or other conditions outside our control. We will not accept purchases of eligible eShepherd neckbands for the purposes of this promotion in Victoria until those approvals or conditions have been satisfied.  If approvals or other regulatory requirements in Victoria are not satisfied before the end of the Qualifying Purchase Period, we may, subject to any necessary regulatory approvals, extend the Qualifying Purchase Period, Promotion Period and any related draw date in accordance with clause 8 so that entrants in Victoria have a reasonable opportunity to make an eligible purchase.
   5. No late entries will be accepted. Incomplete or illegible entries will be deemed invalid.
   6. We may disqualify entries that do not comply with these Terms and Conditions or that we reasonably suspect of fraud or manipulation.
5. Winning a Prize:
   1. We will select one winner by random draw from all valid entries received during the Promotion Period at Suite 7, 670 Canterbury Road, Surrey Hills, VIC 3127 at 12.00pm (local time in Victoria) on 1 May 2026.
   2. The winner will be notified by email (using the contact details provided during their eligible purchase) and may also be contacted by phone within 2 business days, and the winner’s first initial, surname and postcode will be published at https://am.gallagher.com/en-AU/Promotions/buy-and-win within 30 days after the draw and remain available for at least 28 days, and may be published in other promotional material at our discretion, unless the winner requests that their name and postcode not be published.
   3. If the winner cannot be contacted or does not claim the prize by 5.00pm (local time in Victoria) on the date that is 2 months after the draw date, we will conduct a further draw at the same place and by the same method to award the prize. Any redraw winner will be notified within 2 business days of the redraw and the redraw winner’s first initial, surname and postcode will be published at [URL] within 30 days after the redraw for at least 28 days, unless the redraw winner requests not to be published.
   4. Our determination of the winner (and any redraw winner) is final and no correspondence will be entered into, except as required by law.
6. Prize:
   1. The prize is one Gallagher Auto Weigher system, including standard freight to the winner’s property in New South Wales, Victoria or South Australia. The total prize value is AUD 19,799 (including GST), based on recommended retail pricing as at January 2026, plus standard freight.
   2. The prize is not transferable or exchangeable and cannot be redeemed for cash. Any costs associated with installation, set-up, ongoing operation or maintenance of the Auto Weigher system are the responsibility of the winner, unless we expressly advise otherwise in writing.
   3. If the prize specified in the promotion is not available for any reason, Gallagher reserves the right to award an alternative prize of equal or greater value.
   4. The winner takes the prize entirely at their own risk and will be responsible for complying with all laws and requirements relating to the use of the prize.
   5. To the fullest extent permitted by law, Gallagher and its directors, officers and employees are not liable for any loss (including indirect or consequential) arising directly or indirectly from or in connection with this promotion or the prize, including but not limited to technical failures, unauthorised intervention or entries that are not received.  However, nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by any legislation which cannot lawfully be excluded or limited and that includes the consumer guarantees that may apply under the Australian Consumer Law. 
7. Disputes: If a dispute arises concerning any aspect of the promotion (including eligibility), Gallagher’s decision will be final.
8. Changes to the Promotion:
   1. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond our control, we may in our sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.
      
   2. Subject to any written directions from a relevant regulatory authority (including any conditions of a trade promotion authority or permit), we may, if we consider it reasonably necessary to do so:
      i. vary the Promotion, including by extending or shortening the Promotion Period and/or Qualifying Purchase Period; and
      ii. vary the date on which any draw is to take place. 
      
   3. Without limiting clause (b) above, we may exercise these rights if there are delays or issues affecting product approvals, regulatory consents, or if we reasonably consider that varying the Promotion is necessary to avoid disadvantaging entrants.
      
   4. Any changes to the Qualifying Purchase Period, Promotion Period, draw date or other material terms will be published at https://am.gallagher.com/en-AU/Promotions/buy-and-win and will take effect from the time they are published.
      
       
9. Additional Terms:
   1. If you are the winner, you may be asked to participate in reasonable publicity. If you agree, you grant Gallagher a non-exclusive, royalty-free licence for up to 24 months to use your name, photographs, video, voice and likeness in any media for publicity related to the promotion.
      
   2. We collect personal information (including name, contact details and proof of purchase) to run the promotion and award the prize. We may disclose it to service providers and prize suppliers for these purposes. Any personal information collected and stored as part of the promotion will be in accordance with the Privacy Act 1988 (Cth) and Gallagher’s Privacy Statement available at https://www.gallagher.com/privacystatement. We retain promotion records for the period required by law. Marketing communications are optional; you can opt out at any time.
      
   3. Failure by Gallagher to enforce any of its rights at any stage does not constitute a waiver of those rights.
      
   4. These Terms and Conditions are governed by the laws of Victoria, Australia. Each entrant irrevocably submits to the non-exclusive jurisdiction of the courts of Victoria and courts that may hear appeals from those courts.
      
   5. This promotion is a trade promotion lottery conducted in New South Wales, Victoria and South Australia. It is authorised under NSW Trade Promotion Gaming Authority No. TP/04828 and South Australia Trade Promotion Lottery Licence No. T25/2388
      
   6. No permit is required in Victoria, but the promotion will be conducted in accordance with the Gambling Regulation Act 2003 (Vic) and Gambling Regulations 2015 (Vic) and in South Australia in accordance with the Lotteries Act 2019 (SA) and Lotteries Regulations 2021 (SA) and any applicable guidelines issued by Consumer and Business Services.
